Terms of Service

Introduction
These Terms of Service (“Terms”) govern the use of the Gaggle Mail service (“Service”) provided by Seven Forty Six Ltd, a company incorporated in England and Wales (“Gaggle Mail”, “we”, “us”).
By accessing or using the Service, you agree to be bound by these Terms.
We aim to provide a reliable, easy-to-use group email service. You will be informed of any planned downtime where reasonably possible, and we will use commercially reasonable efforts to resolve any unplanned interruptions as quickly as practicable.
Acceptable Use
- No spamming
- No unlawful, unethical, or abusive activity, as reasonably determined by us
- We will not share your data with third parties except as necessary to provide the Service or where legally required
- We may disclose data to law enforcement or regulators where we reasonably believe we are legally required to do so
- You are responsible for all activity conducted through your account
Data Protection & Privacy
Our Data Processing Agreement forms part of these Terms and applies automatically to every customer. It governs how we process personal data that you and your members submit to the Service, including the security measures we apply and the sub-processors we use. If these Terms and the Data Processing Agreement conflict in relation to personal data, the Data Processing Agreement prevails.
For your own account and billing information, Gaggle Mail is the data controller. How we process that information is described in our GDPR statement.

Intellectual Property
Gaggle Mail retains all intellectual property rights in the Service, including the software, platform, and related materials. You retain ownership of all data you submit to the Service. You grant Gaggle Mail a limited, non-exclusive licence to process such data solely for the purpose of providing the Service.
Limitation of Liability
To the maximum extent permitted by law, Gaggle Mail excludes all liability for any indirect, incidental, consequential, or special loss or damage arising out of or in connection with the use of the Service.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot be excluded or limited under applicable law.
Subject to the above, Gaggle Mail’s total aggregate liability arising out of or in connection with the Service shall be limited to the fees paid by you to Gaggle Mail in the 12 months preceding the event giving rise to the claim
These Terms do not affect any statutory rights you may have as a consumer.
Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service if these Terms are materially breached, including for non-payment or misuse of the Service.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
